Indian & Gaming Law


Allen & Desnoyers LLP provides legal and government relations services to both Native and non-Native clients regarding complex matters of Indian and gaming law. Over the past two decades, there has been a dramatic rise in Indian gaming. In New York, tribal casinos are authorized to operate by tribal-state compacts entered into pursuant to the federal Indian Gaming Regulatory Act ("IGRA"). A&D represents individual clients, businesses, government entities, gaming industry participants and associations involved in matters requiring:  
  • negotiation of gaming compacts and related agreements;
  • resolution of jurisdictional disputes;
  • advice on issues arising the interplay between local, state, tribal and federal law and regulation;
  • advice on the doctrine of sovereign immunity; and
  • the acquisition of local, state, tribal or federal approvals.
In addition to Indian gaming, several other forms of gaming are permitted within New York State, including parimutuel wagering on horse racing, lotteries, Video Lottery Terminals (“VLTs”) and charitable gaming.  Horse racing and charitable gaming within New York State are strictly regulated by the State Racing and Wagering Board. Likewise, lotteries and VLT facilities are regulated by the State Division of the Lottery.

 represents clients with matters before these regulatory agencies and advises on the legal requirements applicable to participants in the gaming industry.
