Estate Planning

Allen & Desnoyers LLP provides comprehensive estate planning and litigation services for large and small estates, serving families and individuals throughout New York State. The goals of estate planning are financial and personal in nature. From a financial perspective, careful estate planning can help avoid or reduce estate taxes and preserve a larger share of your legacy for your intended beneficiaries. Assets gifted during life in a correct manner and assets deeded to family members through a trust can have significant tax advantages.

The personal goals of saving time, protecting your family and achieving peace of mind are also powerful benefits of estate planning. A carefully drafted Will has many advantages, including avoidance of probate and a smooth transfer of property to your intended beneficiaries. Trust instruments can also provide security for a child or loved one in need of continued support or financial supervision.

At Allen & Desnoyers LLP, we focus on preserving our client's assets for future generations and providing them with peace of mind. Our lawyers work with clients to reduce or eliminate estate and gift taxes, manage the passing of assets and meet legacy goals through use of a variety of tools, strategies and proceedings available under New York State law, including:

  • wills and trusts, including living wills and special needs trust;
  • trust, estate, and probate administration;
  • intergenerational wealth transfer strategies;
  • business succession planning;
  • power of attorney;
  • health care directives;
  • gifting;

  • guardianships and conservatorships.

Our attorneys are committed to providing personalized service to create an appropriate strategy to meet the individual circumstances of our clients.

Wills, trusts, living trusts, special needs trusts and living wills

There are a number of types of trusts and other planning tools to address particular client circumstances: living trusts, life insurance trusts, qualified personal residence trusts, charitable remainder trusts, family limited partnerships, durable powers of attorney, pour-over wills and others. So, for example, we would assess with the client the benefits of a special needs trusts to assure continued care and benefits when there is a dependent with a disability. We also encourage our clients to use available legal tools, such as living wills and advanced health care directives, to ensure that their wishes are met regarding life-prolonging medical treatments should they become incapacitated.

Intergenerational wealth transfer strategies

At Allen & Desnoyers LLP, we advise clients on the strategies available to preserve wealth and protect assets in the management and distribution of an estate. The ultimate goal is to assure that our client’s wishes are thoughtfully and expeditiously carried out, whether a client wishes to provide for the passing and continued maintenance of a business, devise a charitable gift or endowment, or help finance the education of an upcoming generation.  At the same time, we work to reduce tax burdens and tailor an estate plan to reflect our clients' financial circumstances.

Trust and probate administration

Individuals may sometimes implement a trust that requires a designated third-party to carry out the distribution of their assets according to desired rules and guidelines. Our attorneys are knowledgeable in drafting trusts and understand the processes involved with trust and probate administration. Our attorneys can act as trust and probate administrators as well as advisors to administrators.
